To access certain features, you may need to create an account. You agree to provide accurate, current, and complete information during registration and to keep your account information updated. You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account. You must notify us immediately of any unauthorized use of your account.

Home Town operates as a trading card and collectibles business based in Austin, Texas. Our Services include:

Event hosting and management, including trading card shows, tournaments, and game nights
Online ticket sales and event registration
Vendor booth reservations at events
Membership subscriptions with tiered benefits
In-store retail sales of trading cards, collectibles, and related merchandise
Online marketplace and community features

4. Purchases and Payments

All purchases made through our website or at events are processed via Stripe, our third-party payment processor. By making a purchase, you agree to Stripe's terms of service in addition to these Terms. Prices are listed in U.S. dollars and are subject to applicable sales tax as required by the State of Texas and any other applicable jurisdiction.

5. Memberships

Home Town offers membership subscriptions for both customers and vendors. Memberships are billed on a recurring monthly or annual basis through Stripe. By subscribing, you authorize us to charge your payment method at the applicable recurring interval until you cancel.

You may cancel your membership at any time through your account settings. Cancellation takes effect at the end of your current billing period. No prorated refunds will be issued for partial billing periods. We reserve the right to modify membership benefits, tiers, and pricing with reasonable advance notice. We may offer complimentary memberships at our sole discretion, which may be revoked at any time.

6. Events and Ticketing

Event dates, times, locations, and details are subject to change. We will make reasonable efforts to notify ticket holders of material changes. In the event of a cancellation by us, ticket holders will receive a full refund. Our Return & Refund Policy governs all ticket and booth refunds.

7. User Conduct

You agree not to:

Violate any applicable law, regulation, or ordinance
Use the Services for any fraudulent, misleading, or deceptive purpose
Interfere with or disrupt the Services or servers or networks connected to the Services
Attempt to gain unauthorized access to any portion of the Services
Harass, threaten, or intimidate any other user, vendor, staff member, or event attendee
Resell tickets or booth reservations without our prior written consent
Use automated systems (bots, scrapers, etc.) to access the Services

We reserve the right to suspend or terminate your account and deny you access to our events and retail location for violations of these Terms.

8. Intellectual Property

All content on the Services, including text, graphics, logos, images, and software, is the property of Home Town Collectibles LLC or its licensors and is protected by U.S. and international intellectual property laws. You may not reproduce, distribute, modify, or create derivative works from our content without our prior written consent.

Trading card images, game names, and related intellectual property (including but not limited to Pokemon, Magic: The Gathering, Yu-Gi-Oh!, One Piece, and sports league trademarks) are the property of their respective owners and are used for descriptive and informational purposes only.

9. Third-Party Services

Our Services integrate with third-party platforms including Stripe (payments), Clerk (authentication), and others. Your use of these third-party services is governed by their respective terms and privacy policies. We are not responsible for the practices or content of any third-party services.

10. Disclaimer of Warranties

The Services are provided "as is" and "as available" without warranties of any kind, either express or implied, including but not limited to implied warranties of merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the Services will be uninterrupted, error-free, or secure.

11. Limitation of Liability

To the maximum extent permitted by applicable law, Home Town Collectibles LLC and its officers, directors, members, employees, and agents shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of profits, data, or goodwill, arising out of or in connection with your use of the Services. Our total liability shall not exceed the amount you paid to us in the twelve (12) months preceding the claim.

12. Indemnification

You agree to indemnify, defend, and hold harmless Home Town Collectibles LLC, its members, officers, employees, and agents from and against any and all claims, liabilities, damages, losses, costs, and expenses (including reasonable attorneys' fees) arising out of or related to your use of the Services, your violation of these Terms, or your violation of any rights of a third party.

13. Governing Law and Dispute Resolution

These Terms are governed by and construed in accordance with the laws of the State of Texas, without regard to its conflict of law provisions. Any dispute arising out of or relating to these Terms or the Services shall be resolved exclusively in the state or federal courts located in Travis County, Texas. You consent to the personal jurisdiction of such courts.

We reserve the right to modify these Terms at any time. Material changes will be posted on our website and, where practicable, communicated via email to registered users. Your continued use of the Services after changes become effective constitutes your acceptance of the revised Terms.

15. Severability

If any provision of these Terms is found to be unenforceable or invalid, that provision shall be limited or eliminated to the minimum extent necessary, and the remaining provisions shall remain in full force and effect.
